Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of Live.tau ("Live.τ", "Service", "app", "we", "our"), including the mobile application, related backend services, web pages, notifications, integrations, subscriptions, and experimental features.
The Service is developed and operated by Nikolai Simonov, Belgrade, Serbia. By using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.
Some features may be experimental, limited, unavailable, changed, suspended, or removed at any time. Feature availability may depend on your platform, country, watch model, permissions, subscription plan, build flavor, account status, and provider availability.
2. What the Service Does
Live.τ provides tools for activity telemetry, live location sharing, watch connectivity, route and map features, SOS and safety notifications, Suunto account integration, field notes, audio notes, push-to-talk voice, groups, nearby or Mayday features, automations, subscriptions, stories, and optional broadcast-related functionality.
The Service is not an official emergency service, rescue service, medical device, health monitoring service, navigation authority, or substitute for professional assistance.
3. Eligibility and Account Linking
You must be at least 16 years old to use the Service.
Some features may require linking a Suunto account, using a device identifier, granting device permissions, creating or joining a group, configuring recipients, connecting an integration, or having an active subscription. You are responsible for keeping your accounts, devices, notification recipients, group membership, and integration settings accurate and secure.
Suunto account linking is optional. If you link your Suunto account, your relationship with Suunto / Amer Sports Digital Services remains governed by Suunto's own terms and privacy policies. We are not responsible for Suunto's services, availability, data, or account decisions.
4. Safety and Emergency Disclaimer
SOS, Mayday, SMS, email, push, group, nearby, live sharing, voice, and route features are supplemental tools only.
You must not rely solely on the Service in an emergency. Always contact official emergency services, such as 112, 911, or the relevant local emergency number, when immediate help is needed.
Emergency and safety features may fail, be delayed, or provide inaccurate data due to:
- Lack of cellular, internet, GPS, Bluetooth, watch, microphone, or audio connectivity
- Device battery depletion, power saving mode, app termination, or background restrictions
- Missing permissions or platform limitations
- Provider outages, rate limits, delivery failures, or billing limits
- Incorrect contacts, muted notifications, inactive recipients, or blocked messages
- Software bugs, incorrect configuration, or force majeure events
To the maximum extent permitted by law, we are not liable for failed, delayed, inaccurate, or missed emergency notifications, location updates, voice transmissions, group events, route events, or related safety outcomes.
5. No Warranty and Service Availability
The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, secure, accurate, error-free, available in any location, compatible with every device or watch, or fit for a particular purpose.
We may modify, suspend, limit, or discontinue any part of the Service at any time. We may also impose limits to protect the Service, prevent abuse, comply with law, or manage provider costs.
No service level agreement or uptime guarantee applies unless we separately agree in writing.
6. Subscriptions, Purchases, and Paid Features
Some features may require a paid subscription, paid plan, entitlement, or in-app purchase. Purchases may be processed by Dodo Payments, Google Play, Apple App Store, or another provider shown at checkout.
Prices, plans, entitlements, trials, renewal terms, cancellation options, taxes, and refund rights may depend on the provider and platform used for purchase. You are responsible for reviewing the checkout terms before purchase.
If you purchase through an app store, billing, renewal, cancellation, restore purchase flows, and refunds are generally handled by that app store under its terms. If you purchase through a web checkout or customer portal, billing and cancellation may be handled by the payment provider shown at checkout.
We may verify purchase tokens, transaction identifiers, signed purchase data, product identifiers, provider identifiers, and entitlement state to provide paid features and prevent abuse.
We may block or limit cross-provider changes where an active subscription from another provider exists. You may need to cancel or manage the current subscription with the original provider before starting a different provider.
7. Third-Party Services
The Service uses or may integrate with third-party services, including:
- Suunto / Amer Sports Digital Services, for optional account linking and route-related features
- Google Firebase / FCM, for push notifications
- Twilio, for cloud SMS notifications
- Email delivery providers, for email notifications
- Sentry, for crash reporting and diagnostics
- PostHog, for analytics and, where enabled, session replay or interaction diagnostics
- Better Stack or similar services, for server-side logging and monitoring where configured
- DigitalOcean and related infrastructure providers
- Map and tile providers, including OpenFreeMap, DigitalOcean Spaces, or related providers
- Real-time media or gateway services for push-to-talk, audio, broadcast, or related live features where enabled
- Dodo Payments, Google Play, Apple App Store, or other billing providers
- Zapier, Make, n8n, IFTTT, or other automation providers you connect
- Broadcast destinations, RTMP services, story link destinations, or streaming infrastructure you configure or open
Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party availability, content, security, delivery, outages, pricing, account decisions, or data practices.
8. Location Sharing, Public Links, Groups, and Nearby Features
The Service includes features that can share your location, activity, status, SOS, Mayday, field notes, route, voice state, or telemetry data with other people.
When you share an activity link, use a device-based public link, enable an @username permalink, join a group, enable nearby features, invite members, create shared field notes, configure voice recipients, or configure notification recipients, you are responsible for understanding who may access the shared data.
Public or shared links may be accessed by anyone who has the link. Group members or selected recipients may see your live or recent location, activity status, SOS or Mayday state, voice/PTT state, and related metadata depending on the feature.
You must not use the Service to stalk, harass, monitor, impersonate, or harm another person, or to share another person's location without lawful permission.
9. Field Notes, Media, Voice, Stories, and User Content
You may create, upload, transmit, or interact with text notes, photos, audio recordings, video files, push-to-talk voice, messages, route data, checkpoint data, story interactions, broadcast settings, automation messages, or other content ("User Content").
You retain ownership of your User Content. By using the Service, you grant us a limited license to host, store, process, display, transmit, synchronize, and share User Content as needed to provide the Service, operate configured integrations, support public links, deliver voice or media features, and maintain safety and reliability features.
You are responsible for your User Content and voice transmissions. Do not upload, record, transmit, or share illegal content, confidential information, sensitive personal data, or third-party content unless you have the right and required consent to do so. Do not record or transmit another person's voice where consent is required and you do not have it.
Push-to-talk voice and audio features may be delayed, interrupted, misrouted, unavailable, or affected by Bluetooth, network, microphone, operating-system, background-execution, or provider limitations. They are not emergency communication services.
Stories and in-app content may include official, partner, sponsored, or user-source content, media, calls to action, deep links, and external links. We may target stories by platform, build, or availability and measure story interactions. External links and partner content are governed by their own terms and privacy policies.
We may remove, restrict, or refuse to process User Content that violates these Terms, appears abusive, creates legal risk, or threatens the Service.
10. Routes, Maps, Offline Maps, and Watch Telemetry
Routes, maps, offline maps, checkpoints, nearby cells, and watch telemetry are provided for convenience and activity support only. They may be inaccurate, incomplete, outdated, delayed, or unavailable.
You are responsible for route choice, navigation decisions, environmental conditions, safety, equipment, and compliance with local laws. Do not rely solely on the Service for navigation or safety-critical decisions.
Watch telemetry, including heart rate, speed, cadence, power, temperature, battery status, motion data, or similar metrics, is provided for activity context only. The Service is not a medical device and must not be used for medical diagnosis, treatment, or emergency health monitoring.
11. Automations and Checkpoint Actions
If you connect automation providers or configure checkpoint actions, you authorize us to send event payloads to the providers or endpoints you select. Payloads may include session identifiers, device identifiers, timestamps, event types, location, checkpoint data, crossing location, field note events, and message content.
You are responsible for configuring automations correctly and for any downstream actions triggered by your automation provider. We are not responsible for third-party automation failures, delays, misfires, data handling, or consequences.
12. Broadcast and Streaming Features
If broadcast features are available and you use them, you are responsible for the broadcast destination, stream key, RTMP settings, gateway settings, authentication token, bitrate, codec, orientation, and any content transmitted through the configured destination.
Do not use broadcast features to transmit illegal, private, confidential, or third-party content without permission. Broadcast providers and destinations are governed by their own terms.
13. SMS, Email, and Push Notifications
Notifications may be delayed, blocked, dropped, rate-limited, or unavailable. SMS limits may apply, including monthly per-device limits or provider limits. Some builds may support sending SMS directly from your device, which may be subject to your carrier plan, permissions, and local laws.
You must only add phone numbers or email addresses where you have a lawful basis and the recipient's permission where required. You must not use notifications for spam, harassment, false emergencies, or abuse.
Recipients may unsubscribe or be removed where supported.
14. Privacy
Personal data collection and processing are described in the Privacy Policy. By using the Service, you acknowledge that the Service may process location data, watch telemetry, emergency data, selected contacts, field notes, media, microphone/audio data, story interactions, analytics, diagnostics, subscription data, and integration data as described in the Privacy Policy.
15. Acceptable Use
You agree not to:
- Use the Service for illegal, harmful, abusive, fraudulent, or deceptive purposes
- Abuse SOS, Mayday, emergency, SMS, email, push, group, nearby, voice, automation, story, or broadcast features
- Share false, misleading, or spoofed location, telemetry, voice, or emergency data
- Stalk, harass, track, record, or monitor another person without lawful permission
- Interfere with, disrupt, overload, reverse engineer, scrape, or compromise the Service
- Attempt to bypass subscription, entitlement, security, rate limit, or access controls
- Upload malware, illegal content, or content that infringes third-party rights
- Use the Service in a way that violates third-party terms, app store rules, telecom rules, recording-consent laws, or applicable law
16. Intellectual Property
The app, software, design, trademarks, backend services, stories, documentation, and related materials are owned by the Developer or licensors and are protected by applicable laws.
Subject to your compliance with these Terms, you receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or permitted activity purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except where permitted by law.
17. Termination and Suspension
You may stop using the Service at any time. You may also remove configured recipients, unlink Suunto, disconnect integrations, cancel subscriptions through the relevant provider, clear local caches where available, or uninstall the app.
We may suspend, limit, or terminate access to the Service if you violate these Terms, abuse the Service, create legal or security risk, fail to pay for paid features, or if we discontinue a feature or the Service.
Termination may not automatically delete all data. Data deletion and retention are handled as described in the Privacy Policy and applicable law.
18. Limitation of Liability
To the maximum extent permitted by law, the Developer and Service are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, device availability, provider availability, emergency outcomes, location accuracy, route accuracy, notification delivery, voice delivery, subscription availability, story content, or third-party actions.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
19. Changes to the Service and Terms
We may update these Terms from time to time. Material changes may be communicated through the app, website, email, or another reasonable channel. Continued use of the Service after changes become effective means you accept the updated Terms.
20. Governing Law and Disputes
These Terms are governed by the laws of Serbia, unless mandatory consumer protection laws in your country require otherwise.
Any disputes shall be resolved in the competent courts of Belgrade, Serbia, unless applicable law gives you mandatory rights to bring claims elsewhere.

22. Acceptance
By using the Service, you confirm that you have read, understood, and accepted these Terms. If you do not agree, you must not use the Service.
